By accessing or using Trackify ("Service"), operated at eu.trackify.net by Trakifaj Pro d.o.o. ("Company", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms").

If you do not agree with any part of these Terms, you may not access the Service.

2. Description of Service

Trackify provides a shipment tracking and advertising management platform that includes:

• Shipment tracking and logistics management
• Google Ads Performance Max campaign management
• AI-powered advertising creative generation
• Landing page creation and management
• Analytics and reporting tools

3. Account Registration

3.1 Account Creation

To use our Service, you must:

• Be at least 18 years of age
• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access

3.2 Account Responsibility

You are responsible for all activities that occur under your account. We are not liable for any loss or damage arising from your failure to protect your account credentials.

4. Google Ads Integration

4.1 Authorization

By connecting your Google Ads account to our Service, you authorize us to:

• Access your Google Ads account information
• Create, modify, and manage campaigns and asset groups
• Upload advertising assets (images, text, headlines)
• Retrieve performance metrics and analytics

4.2 Your Responsibilities

When using our Google Ads features, you agree to:

• Comply with Google Ads Policies
• Ensure you have the right to use any content uploaded through our Service
• Not use our Service to create deceptive or misleading advertisements
• Accept responsibility for all advertising costs incurred in your Google Ads account

4.3 Revoking Access

You may disconnect your Google Ads account at any time through your Google Account Permissions or by contacting us.

5. AI-Generated Content

5.1 Content Generation

Our Service uses artificial intelligence to generate advertising content including:

• Headlines and descriptions
• Marketing images
• Landing page content

5.2 Content Review

You are responsible for reviewing all AI-generated content before publication. We do not guarantee that generated content will:

• Be approved by advertising platforms
• Be free from errors or inaccuracies
• Meet specific performance targets
• Comply with all applicable laws and regulations

5.3 Content Ownership

You retain ownership of your original product information and business data. AI-generated content created using our Service is licensed to you for use in your advertising campaigns.

6. Acceptable Use

You agree not to use the Service to:

• Violate any applicable laws or regulations
• Infringe on intellectual property rights of others
• Create advertisements for prohibited products or services
• Transmit viruses, malware, or harmful code
• Attempt to gain unauthorized access to our systems
• Interfere with the proper operation of the Service
• Collect user data without consent
• Engage in fraudulent or deceptive practices

7. Fees and Payment

7.1 Service Fees

Certain features of our Service may require payment. All fees are:

• Stated in Euros (EUR) unless otherwise specified
• Non-refundable unless otherwise stated
• Subject to change with 30 days notice

7.2 Third-Party Costs

You are solely responsible for any costs incurred with third-party services, including:

• Google Ads advertising spend
• Domain registration fees
• Payment processing fees

8. Intellectual Property

8.1 Our Property

The Service, including its design, features, code, and content, is owned by Trackify and protected by intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the Service.

8.2 Your Content

You retain ownership of content you upload to the Service. By uploading content, you grant us a license to use, store, and process it as necessary to provide the Service.

9. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.

10. Disclaimers

10.1 Service "As Is"

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

10.2 Advertising Results

We do not guarantee any specific advertising results, including:

• Number of impressions, clicks, or conversions
• Return on advertising spend (ROAS)
• Ad approval by any platform
• Revenue or sales increases

10.3 Third-Party Services

We are not responsible for the actions, content, or policies of third-party services, including Google Ads, payment processors, or other integrated platforms.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRACKIFY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits or revenue
• Loss of data
• Loss of business opportunities
• Advertising costs or wasted ad spend

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify and hold harmless Trackify and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Content you upload or create using the Service

13. Termination

13.1 By You

You may terminate your account at any time by contacting us. Upon termination, your right to use the Service will immediately cease.

13.2 By Us

We may suspend or terminate your account at any time for:

• Violation of these Terms
• Fraudulent or illegal activity
• Non-payment of fees
• Extended periods of inactivity
• Any other reason at our sole discretion

13.3 Effect of Termination

Upon termination:

• Your access to the Service will be revoked
• We may delete your data after a reasonable period
• Provisions that should survive termination will remain in effect

14. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

• Posting the updated Terms on our website
• Sending an email to your registered address
• Displaying a notice within the Service

Continued use of the Service after changes constitutes acceptance of the modified Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Croatia, without regard to its conflict of law provisions.

Any disputes arising from these Terms shall be resolved in the courts of Osijek, Croatia.

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Trackify regarding the Service and supersede all prior agreements.
